This Notice of Privacy Practices applies to Joyful Therapy Group, operated by Joyful Marriage and Family Therapy, Inc., and California Virtual Eating Disorder Experts (CVED Experts), operated by Family Therapy for Joyful Eating, Inc. (together, “we,” “us,” “our”). It covers all of our clinicians, dietitians, psychiatric providers and staff.
We are required by law to keep your protected health information (PHI) private, to give you this notice of our legal duties and privacy practices, to follow the notice currently in effect, and to notify you if a breach affects your unsecured PHI. California law, including the Confidentiality of Medical Information Act, sometimes gives you more protection than federal law. When it does, we follow the law that protects you more.
Treatment. We share information among the members of your care team, for example your therapist, dietitian, psychiatric provider and case manager, and with outside providers who are treating you, such as your doctor or psychiatrist.
Payment. We share information with your health plan or a billing service to verify benefits, request authorizations and get paid for your care.
Health care operations. We use information to run our practice, for example quality review, training and supervision of clinicians, licensing and accreditation.
Business associates. We work with companies that help us operate, such as our electronic records, billing, scheduling, phone and website providers. Each signs an agreement requiring them to protect your information.
Appointment reminders and communication. We may contact you by phone, text or email about appointments, scheduling and your care, using the contact preferences you give us.
We may share information without your permission when the law requires or allows it, including: to prevent or lessen a serious and imminent threat to your health or safety or that of others; to report suspected child, elder or dependent adult abuse or neglect; for public health activities; for health oversight activities such as audits and licensing; in response to a court order or as otherwise required in legal proceedings; to law enforcement as required by law; to coroners and medical examiners; for workers’ compensation as allowed by law; and for specialized government functions.
We will not use or share your information for any other purpose without your written authorization. This includes most uses of psychotherapy notes, any marketing use, and any sale of your information, which we never do. You may revoke an authorization in writing at any time, except to the extent we have already acted on it.
With your agreement, or if you have the chance to object and do not, we may share information with a family member, partner or other person involved in your care or payment for your care. For clients who are minors, parents and guardians generally have access to information, except where California law gives the minor the right to consent to their own care and to control their records.
Get a copy of your records. You can ask to see or get an electronic or paper copy of your records. We will respond within the time allowed by law and may charge a reasonable, cost-based fee.
Ask us to correct your records. You can ask us to amend information you believe is incorrect or incomplete. We may say no, and if we do we will tell you why in writing.
Request confidential communications. You can ask us to contact you in a specific way, for example only by a certain phone number or email. We will agree to reasonable requests.
Ask us to limit what we use or share. You can ask us not to use or share certain information. We are not required to agree, except that if you pay for a service in full out of pocket, you can ask us not to share it with your health plan and we will agree unless the law requires us to share it.
Get a list of disclosures. You can ask for a list of the times we have shared your information in the six years before your request, with certain exceptions.
Get a copy of this notice. You can ask for a paper copy at any time, even if you agreed to receive it electronically.
Choose someone to act for you. A personal representative, such as a legal guardian, can exercise your rights.
If you have questions about this notice or want to use any of these rights, contact our Privacy Officer.
If you believe your privacy rights have been violated, you can file a complaint with our Privacy Officer or with the U.S. Department of Health and Human Services, Office for Civil Rights, at www.hhs.gov/ocr/complaints or 1-877-696-6775. We will not retaliate against you for filing a complaint.
